Welcome to Climb Shack! These Terms and Conditions (“Terms”) govern your access to and use of https://climbshackph.com (the “Website”) and your purchase of day passes, memberships, classes, or other services offered by Climb Shack, a trade name of JET Physical Corporation (“Climb Shack,” “we,” “us,” or “our”).
PLEASE READ THESE TERMS CAREFULLY BEFORE USING THE WEBSITE OR PURCHASING ANY PASS, MEMBERSHIP, OR SERVICE. BY ACCESSING THE WEBSITE, CREATING AN ACCOUNT, OR PURCHASING A PASS OR MEMBERSHIP, YOU ACKNOWLEDGE THAT YOU HAVE READ, UNDERSTOOD, AND AGREE TO BE BOUND BY THESE TERMS, OUR PRIVACY POLICY, AND ANY POSTED GYM RULES. IF YOU DO NOT AGREE, PLEASE DO NOT USE THE WEBSITE OR OUR SERVICES.
Definitions: “User,” “You,” and “Your” refer to any person accessing the Website or purchasing a pass, membership, or service. “Climb Shack,” “the Company,” “We,” “Us,” and “Our” refer to JET Physical Corporation operating under the trade name Climb Shack. “Services” refers to indoor climbing facility access, day passes, memberships, classes, events, and related offerings made available through the Website or on-site. These Terms are governed by the laws of the Republic of the Philippines.

1. Eligibility
The Website and Services are available to individuals with the legal capacity to enter into binding contracts under Philippine law. By using the Website or purchasing a pass or membership, you represent that you are at least 18 years old, or that you are accessing/purchasing on behalf of a minor as their parent or legal guardian and accept full responsibility for that minor’s participation, including execution of any required waiver.
2. Passes, Memberships, and Bookings
All day passes, class bookings, and memberships purchased through the Website are subject to availability and Climb Shack’s then-current pricing, which may change without prior notice.
Passes and memberships are non-transferable unless expressly stated otherwise at the point of sale.
A valid government-issued ID may be required at check-in to verify your identity against your pass or membership.
Memberships automatically apply the terms (duration, renewal, access hours) disclosed to you at the time of purchase. Please review these details carefully before completing your purchase.
Climb Shack reserves the right to suspend or terminate a pass or membership for violation of these Terms, posted gym rules, or unsafe conduct, without refund, where such violation poses a safety risk to the user or others.
3. Payments and Third-Party Payment Processing
All payments for passes, memberships, and other paid Services are processed through a secured third-party payment gateway. Upon checkout, you will be redirected off the Climb Shack Website to complete payment.
Climb Shack does not store your full payment card details on its servers. Your payment information is handled directly by our third-party payment partner in accordance with its own security standards and terms of service.
Climb Shack is not responsible for any errors, delays, security incidents, or disputes arising from the third-party payment platform itself; such issues should also be raised with the payment provider, in addition to notifying us.
You are responsible for ensuring that payment details you provide are accurate and that you are authorized to use the selected payment method.
4. Refunds, Cancellations, and Rescheduling

5. Assumption of Risk and Release of Liability
Indoor rock climbing and related activities (including bouldering, top-rope climbing, lead climbing, and use of climbing equipment and facilities) involve inherent risks of physical injury, including serious injury, permanent disability, or death, whether caused by the user’s own actions, the actions of others, equipment, or facility conditions.
By purchasing a pass or membership and/or using Climb Shack’s facilities, you acknowledge and agree that:
You participate in climbing activities voluntarily and at your own risk;
You are physically fit and have no medical condition that would make climbing unsafe for you, or you have disclosed such conditions to Climb Shack staff prior to participating;
You will comply with all posted safety rules, staff instructions, and equipment usage guidelines;
To the fullest extent permitted by Philippine law, you release Climb Shack, JET Physical Corporation, and their owners, officers, employees, and agents from liability for injury, loss, or damage arising from your voluntary participation in climbing activities, except where such injury, loss, or damage is caused by the gross negligence or willful misconduct of Climb Shack or its staff, which liability cannot be waived under Philippine law.
A separate, signed physical or digital waiver and release form is required before your first climbing session. This Section summarizes but does not replace that waiver. Nothing in these Terms is intended to limit or exclude liability for death, personal injury, fraud, or any liability that cannot be excluded under applicable Philippine law (including the Civil Code and the Consumer Act of the Philippines).
6. Gym Rules and Conduct
Users must comply with all posted gym rules, safety briefings, and staff instructions while on Climb Shack premises, including but not limited to rules on proper footwear, spotting, use of climbing holds and equipment, and conduct toward other climbers and staff. Climb Shack reserves the right to refuse service, revoke access, or remove any user from the premises for unsafe, disruptive, or abusive conduct, without refund.
7. Website Content and Intellectual Property
Unless otherwise stated, Climb Shack (JET Physical Corporation) owns or licenses all intellectual property rights in the content on this Website, including text, graphics, logos, and images. You may view and use this content for personal, non-commercial purposes only. You must not:
Republish, resell, rent, or sub-license material from the Website;
Reproduce, duplicate, or copy material from the Website for commercial purposes;
Use Climb Shack’s name, logo, or branding without prior written permission.
8. User-Generated Content (e.g., Reviews, Comments)
If the Website allows users to submit comments, reviews, or other content, you represent that: (a) you have the right to post such content; (b) it does not infringe any third party’s intellectual property or privacy rights; and (c) it is not defamatory, obscene, unlawful, or used to solicit commercial activity. Climb Shack reserves the right to monitor and remove any content that violates these Terms. Climb Shack does not necessarily endorse and is not responsible for user-submitted content, except as required by applicable law.

Content on the FAQs and About Us pages is provided for general informational purposes and is updated periodically. While we aim to keep this information accurate and current, Climb Shack does not guarantee that all details (e.g., pricing, hours, facility features) are error-free at all times; please confirm time-sensitive details (e.g., current promotions, operating hours) directly with our staff or Contact Us page.
10. Facility Availability and Force Majeure
Climb Shack will make reasonable efforts to keep the facility and Website available and services as scheduled, but is not liable for closures, delays, or service interruptions due to circumstances beyond its reasonable control, including but not limited to maintenance, equipment failure, government regulations, natural disasters, power outages, or other force majeure events.
11. Limitation of Liability
To the maximum extent permitted by Philippine law, Climb Shack and its affiliates, officers, employees, and agents shall not be liable for any indirect, incidental, or consequential loss or damage arising from your use of the Website or Services, except where such liability cannot be excluded under applicable law (including liability for death, personal injury, fraud, or gross negligence, as described in Section 5).
12. Hyperlinking and iFrames
Government agencies, search engines, news organizations, and similar entities may link to our Website without prior approval, provided the link is not deceptive and does not falsely imply endorsement. Other organizations wishing to link to our Website should contact us for approval. No framing of our Website that alters its visual presentation is permitted without our prior written consent, and no use of Climb Shack’s logo or artwork is permitted for linking purposes without a written license.
